Benefits of Asylum

After you are granted asylum, you will be able to apply for benefits related to immigration as well as receive government benefits and services. If they were included in your asylum application and they are already in the U.S. they will automatically receive asylum. If they are overseas or not included in your application, you may file a petition to obtain asylum for them.

Other benefits of asylum include:

  • Access to Refugee Resettlement Agency (RRA) which helps you adjust to life in the U.S.
  • Automatic eligibility to work in the U.S. without an Employment Authorization Document (EAD).
  • Ability to apply for a Social Security card.
  • Ability to obtain an ID card or driver's license.
  • Ability to apply for a green card 1 year after asylum is granted.
  • and more

What Counts as Persecution?

In immigration law, the Immigration and Nationality Act (INA) does not provide specifics on what persecution actually is except for in a situation that involves a “coercive population control program” where the individual is “forced to abort a pregnancy or to undergo involuntary sterilization”. Otherwise, persecution, means that the applicant must be able to prove that the threats are so severe they will occur no matter what part of the country they are living in; it is a nationwide threat and they cannot avoid it by relocating to another part of the country.

Below are some examples of persecution:

  • Discrimination
  • Threats of harm
  • Mental, emotional, or psychological harm
  • Physical violence
  • Violations of human rights
  • Disproportionate punishment for a crime
  • Unlawful detention
  • Torture
